Burglary Charges in Arizona
In the State of Arizona, burglary is defined as entering or remaining unlawfully in or on any building or structure with the intent of committing a theft or felony once inside. Interestingly, you do not actually have to steal anything to be charged with burglary, your intent upon entry is the key. For burglary, there is a distinction between whether the structure is a residential or commercial structure.
There is also a distinction between whether or not a weapon or dangerous instrument is possessed or used during the commission of the burglary offense.
Burglary as defined above can be classified as a class 2, class 3 or class 4 felony, and can be punishable by a range of penalties from probation to 12.5 years in prison, increased if there is prior felony criminal history.
Burglary in the 3rd Degree is defined by: (1) entering or remaining unlawfully in or on a nonresidential structure or in a fenced commercial or residential yard with the intent to commit any theft or felony therein. (2) Making entry into any part of a motor vehicle by means f a manipulation key or master key, with the intent to commit any theft or felony in the motor vehicle. Burglary in the 3rd degree is a class 4 felony.
Burglary in the 2nd Degree is defined by entering or remaining unlawfully in or on a residential structure with the intent to commit any theft or any felony therein. Burglary in the 2nd Degree is a class 3 felony.
Burglary in the 1st Degree is defined by all the elements of either a 2nd or 3rd Degree Burglary if committed and the person or accomplice knowingly possesses explosives, a dangerous instrument or a deadly weapon. The burglary is of a nonresidential structure or fenced commercial or residential yard is a class 3 felony. It is a class 2 felony if committed in a residential structure.
